Resolution to Rescind Resolution No. 2011-154,  Award of Construction Contract to Musco Excavation, Inc. for the 14901 East 14^th Street Demolition Project, Project No. 11-962-39-001

Body

                     WHEREAS, the City Council on September 6, 2011, by Resolution No. 2011-154 awarded a construction contract to Musco Excavation, Inc. for the 14901 East 14^th Street Demolition project, Project No. 11-962-39-001; and

                     WHEREAS, after the award, Musco Excavation, Inc. notified the City Engineer that it was unable to execute the contract, to which the City took action to advance upon Musco Excavation, Inc.’s bid security to recover the difference between its bid and the next lowest responsible bidder’s bid, and to notify the next lowest responsible bidder, VEM General Engineering, that it would be awarded the contract for the Project

                     NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows:

                     That the City Council hereby rescinds City Council Resolution No. 2011-154, which awarded the construction contract for 19401 East 14^th Street Demolition Project, Project No. 11-962-39-001 to Musco Excavation, Inc.
