SUMMARY AND RECOMMENDATIONS
Staff recommends that the City Council adopt the resolution amending the City’s Fee Schedule to increase the subpoena fee for personal appearance of police officers from $150 to $275 to conform with changes to state law.
BACKGROUND
Assembly Bill 2612 amended California Government Code Section 68097.2 to increase the witness fee for specified public employees, including police officers, from $150 to $275 per day. Because the fee is listed in the City’s Fee Schedule, the Fee Schedule must be amended to reflect the increase. Increases to City fees require a public hearing. A Notice of Public Hearing was published in The Daily Review on February 15 and 22, 2013.
Current Agency Policies
• The City of San Leandro Fee Schedule is contained in Title 6, Chapter 4 of the San Leandro Administrative Code.
Fiscal Impacts
This action will result in a small increase to General Fund revenue. The Resolution provides that the Fee Schedule as amended will immediately go into effect.
